Sentencing Date Set for Carmi Man After Guilty Plea in Aggravated DUI

CARMI – A March 3 sentencing date has been set for a Carmi man after he pleaded guilty Monday in White County Court to Aggravated DUI Resulting in Death related to a motor vehicle accident that killed a Norris City man last summer.

According to White County State’s Attorney Denton Aud, 49-year-old Brian W. Dartt was charged with a Class 2 felony with a sentencing range of three to 14 years in the Illinois Department of Corrections. He will have to serve 85 percent of the sentence, according to Aud, noting Dartt could alternatively be sentenced to probation up to four years. However, the court would have to find that extraordinary circumstances exist to impose a sentence of probation.

Aud saidin pleading guilty, Dartt acknowledged that he operated a motor vehicle on July 31, 2021, at a time that he had methamphetamine in his system and that he caused an accident that was the proximate cause of Clinton J. Richardson’s death.

The case was investigated by the Illinois State Police with assistance from the White County Sheriff’s Department and White County Coroner’s Office.

In exchange for his guilty plea to the most serious offense that he could be charged with, the other offenses against Dartt were dismissed.

Since Dartt pled guilty Monday, Aud says a jury trial in this case set for Jan. 18 will now not take place.
